Issues
Did the trial court err in denying Defendant’s Motion in Limine and allowing Plaintiff’s orthopedic witness to tes- tify that the Plaintiff ’s erectile dysfunction was causally related to his lower back injury following which the jury awarded $111,662.50?
Did the trial court err in reopening a case following an order dismissing the case with prejudice subject to the “right of a party to move for good cause shown within 30 days to reopen this action, if settlement is not consummated,” Plain- tiff, after 30 days, filed its motion to set aside the settlement on the issue of whether his attorneys were authorized to enter into it?
Did the trial court err in granting Summary Judgment not- withstanding expert testimony presented by the Plaintiff with respect to the Defendant’s use of a new FDA-approved medical procedure, i.e. a BAK fusion system for his spinal fusion?
Did the appellant substantially comply with the 180-day notice to county requirement and, was the county preju- diced by the delay?
Did the trial court err in directing a verdict on behalf of the municipality with respect to the allegations brought against it on the grounds that the Plaintiff had not shown the req- uisite degree of malice?
Did the trial court err in ruling that the Defendant Shop- pers Food Warehouse had no legal responsibility for the dangerous condition directly adjacent to its store as main- tenance of the parking area was the shopping center’s responsibility under the lease?
Did the trial court err in failing to award attorneys’ fees or costs after a successful jury trial where damages were awarded under the Maryland Consumer Debt Collection Act and in not requiring the production of attorney time and bill- ing records by Defendants’ counsel?
Did the trial court err in not granting a mistrial requested when Defense counsel Michael DeSantis erroneously al- leged during cross-examination of the Plaintiff that she had a prior felony theft conviction? The Motion for Mistrial was again sought when the jury returned a Defendant’s ver- dict on this dump truck rear-end accident with $26,000 in medical expenses and over $6,000 in loss of income with permanent injury.
