He further tes- tified that he has no explanation for the acute swelling in Plaintiff’s right leg. Ac- cording to Dr. Shugoll, bruising is indicative of soft tissue damage that is evidence of a trauma sufficient in force to cause lymphadema.


Injures/Damages: Acute unilateral lymphadema in right leg. Plaintiff ’s col- lision related medical expenses were $7,847.02, including $3,793.07 for the sequential intermittent compression pump, and nylon sleeve.

John Shourds et al. v. Strickland, Allstate and Nationwide Circuit Court for Prince George’s County, Maryland Case No. 99-16111 & 00-05002


Facts: Plaintiff John Shourds pulled onto highway from stop sign when he was struck by Strickland’s vehicle proceeding on highway at speed of 100 plus miles per hour.


John Shourds received various in-


juries which resolved with residuals. Julie Masters, adult passenger & mother of Joshua Shourds (another 4 yr. old passen- ger) was killed instantly; Joshua Shourds received physical injuries that resolved without residuals; Brittany Shourds re- ceived physical injuries that resolved without residuals; Alexandra Shourds was treated for broken leg that needed two surgeries and left a 12 inch scar on out- side of thigh. Treatment for the children was rendered at Children’s Hospital in D.C. Treatment to Mr. Shourds at Wash- ington Hospital Center. Master’s estate was not part of suit.


Verdict/Settlement: Settled at settlement conference before Judge Howard Chasnow. John Shourds $30,000 (State Farm policy); Joshua Shourds $100,000 ($20,000 State Farm policy & 80,000 Allstate policy); Brittany Shourds $40,000 ($20,000 State Farm policy & $20,000 Nationwide policy);

Shourds $150,000 ($20,000 State Farm policy & $130,000 Nationwide policy)


Special Remarks: Multiple underinsured coverages stacked using VA Statute where Plaintiffs all lived.


Joshua capped at


$100,000 under statute and only Brittany and Alexandra could claim under Nation- wide Policy..
