George’s County Issues

Under Rule 1-341, can the court award sanctions against a person who is not a party to the case, even if that person was an owner, officer and/or director of a corporate party? Can appellee’s attorney justify his legal bills by his own at- testation of their fairness and reasonableness?

Did the trial court err in granting the defendant members of the Sligo Seventh-Day Adventist Church’s motion to dismiss a defamation action brought by its pastor whose parishioners had allegedly defamed him leading to his ter- mination?

Did the circuit court err in granting summary judgment in favor of the defendant holding that plaintiff’s expert wit- ness, Dr. Jessie Palmer’s testimony and affidavit were insufficient to establish the standard of care in 1981-1982 and the causal relationship of plaintiff’s brain damage?

Did the trial court err in granting summary judgment to the defendant when it was alleged that the tenant’s fall on snow and ice was occasioned at least in part due to the way in which waste water was designed to drain over a pathway where plaintiff fell?

Did the trial court err in dismissing plaintiff’s action titled “Civil Action for Denial of Special Education” relying on a federal statute, holding that any such claim can only be brought before the Maryland Office of Administrative Hearings, with appellant’s sole remedy an administrative appeal?

Did the circuit court err in affirming an award of arbitra- tion titled “Arbitrator’s Reasons for His Award” which failed to address all claims presented, and failed to provide a writ- ten opinion giving the reasons for the award as expressly required by the arbitration clause?

Did the trial court err in failing to give a requested instruc- tion on contributory negligence when a Wendy’s customer and employee’s verbal altercation resulted in injuries to the plaintiff. The jury awarded $40,000 for negligence by the security officer in allowing the situation to get out of hand.

Did the trial court err in granting plaintiff’s motion for directed verdict on the issue of liability in this motor ve- hicle intersection accident, and in failing to strike the economic testimony of economist Dr. Borzilleri, who testi- fied as to future economic loss due to plaintiff’s inability to maintain his rental properties based solely on plaintiff’s counsel’s letter (and plaintiff’s oral testimony) when there was no medical testimony in support of said disability?
