Doe Adm. v. Local Hospital District of Columbia


Facts of Case: Mrs. Doe was admitted to Local Hospital the surgical removal of a


brain tumor which had been causing her to lose her eyesight. At the time she was 70 years old. According to the family, a few days after the successful procedure, a nurse suddenly began to pour apple juice into her as she coughed and gagged. She developed aspiration pneumonia and adult respiratory distress syndrome. She was beginning to recover when one day a doctor walked past her room and found the door closed. Upon entering her room, he found that the ventilator had become disconnected and the alarm apparently was not being heard by the nursing staff. Mrs. Doe survived for a period of time thereafter and ultimately died. Plaintiff alleged that there was nursing negligence in the feeding and also failure to properly monitor her condition through a central monitor or through proper observation.


Verdict/Settlement: The case was settled at pretrial for an undisclosed sum.

Facts: While being assisted from bed to chair, Plaintiff was allowed to fall, injur- ing low back and sustaining damage to nerve resulting in neurogenic bladder and bowel.

Verdict/Settlement: The case was settled prior to the filing of suit for $325,000.00.

Facts: Despite being classified a high-risk obstetrical patient due to several under- lying medical conditions, Roe Hospital did not provide Jane Doe with the proper obstetric standards of care. The Hospital failed to recognize signs and symptoms of intrauterine growth retardation. If ap- propriately aggressive antenatal testing had been performed, intrauterine growth retardation would have been discovered and treated. Instead, the fetus died in utero at 37 weeks.


Verdict/Settlement: This matter was settled for $400,000.00 before a lawsuit was filed.
