Nursery stock/perishable goods/live plant ma- terial is/are shipped as close to planting time as possible, and not prior to March 1st due to the danger of freezing in transit. Only limited nursery stock will be shipped after June 1st.

We guarantee that the seeds we sell conform to the label description, as required by State and Federal Seed Laws, within recognized tolerances. We make no other guarantees, expressed or implied, of merchantability, fi t- ness for purpose, or otherwise, of the seed or the crops grown from the seed, other than germination. Our liability,
for the breech
of this guarantee, whether contractual, for negligence, or for any other reason, is limited to either a credit voucher for the purchase price or replacement of such seeds, either act of which shall constitute full and complete adjustment and release. Any plant materials that fail to grow will be replaced one time or a credit voucher (our choice) provided we are notifi ed by October 1 of the year of purchase and the item has been properly cared for and in the planting zone noted in the catalog. Annual plants such as tomato, pepper and herbs are only guaranteed to arrive in good shape. If you have a problem upon arrival, please notify us immediately (within 10 days) so we can take care of the problem for you. We guarantee you complete satisfaction with our gardening supplies (non-growing items) when used according to the manufacturer’s instruction. Report of unsatisfactory garden accessories must be reported within 30 days for replacement, credit voucher or refund. Only manufacturer’s guarantee (if any) ap- plies after 30 days. We reserve the right to re- quest return of the product deemed unsatis- factory prior to approval of any adjustment.
NOTICE ABOUT OUR SEEDS AND THE LAW. Shumway seeds are tested to ensure that they meet or exceed U.S. government standards. The packets are color coded to in- dicate various seed lots. Vegetable and fl ower seeds are shipped untreated except in rare in- stances when only treated seed is available.
NO GENETICALLY MODIFIED SEED OR PLANTS are knowingly sold by Shum- way. They are defi ned as mechanical transfer of genetic material between genera, families or kingdoms.
HARDINESS ZONE MAP
This USDA map divides the country into plant hardiness zones based on average lowest winter temperatures as shown in the chart. Zone boundary lines are not absolute. Temperatures and wind chills can vary. You should consider local conditions like hills, valleys, rainfall, wind, snow coverage and soil. For instance, a certain plant may survive fi ne in Zone 3 in Maine, but not in North Dakota, simply because of differenc- es in rainfall, wind chill or humidity. So be fl exible. Use this informa- tion as a guide when local information is not available to supercede it.
