The road ahead We have a date for the launch of new generic top-level domains (gTLDs). Or at least, we think we do. ICANN head Fadi Chehadé mentioned April 23 of this year, but couched his comments in just enough ‘wriggle room’ to mean that the date can’t be taken as firm. Nonetheless, it seems a fair bet that by the early summer, at least some of the new gTLDs will have been delegated. It’s a big moment for brands, although it’s worth bearing in mind that internationalised domain names (IDNs) will be delegated into the system first.


So there’s not long to go, and yet some IP owners would argue that plenty of questions remain, especially in terms of the trademark protections afforded under the new system. But hope springs from unlikely sources. In this issue of Trademarks Brands & the Internet, we talk to applicants for open gTLDs about some of the innovative solutions they are developing to enhance or complement the existing protections in the system. Perhaps the registries themselves will do what ICANN has been unable or unwilling to.


Te phenomenon of social media is oſten cited as one of the biggest emerging challenges for brand owners, whether that’s policing their IP or handling PR disasters. In all the noise, it can be easy to forget that sometimes, brands get it just right. We take a look at eight of the best social media campaigns, from Nike to Heineken, discovering that you don’t need to spend a lot of money to make a big splash.


One interesting trend has been the tendency of advertisers to exploit popular Internet memes, capitalising on an existing online buzz to promote their products. But memes, which by their very nature tend to be amalgams or developments of existing copyrighted work, pose potential problems for their ‘creators’ and the owners of existing IP that’s used in a meme. We ask industry experts and fair-use proponents for their views on the lie of the land in this complex area.
