Reference in Regulations, was introduced in the Senate on 17 October 2012. Bill S-12, a rather technical Bill, proposes changes to Canadian administrative law as it relates to delegated legislation. It would grant regulation-making authorities the express power to incorporate, by reference, materials in regulations, while imposing on the same authorities the obligation to render publicly accessible the materials incorporated by reference. projects.” Finally, Bill S-13, the Port
State Measures Agreement Implementation Act, was introduced in the Senate on 8 November 2012, with – as its title suggests – the aim of incorporating the provisions of the Port State Measures Agreement into Canadian law. In 2010, Canada signed the
Port State Measures Agreement which had been adopted by the Food and Agriculture Organization of the United Nations in 2009. The main purpose of the Agreement is to prevent, deter and eliminate illegal, unreported and unregulated fishing through the implementation of robust port state measures. On the day the Bill was introduced, Hon. Gail Shea, MP, Acting Minister of Fisheries and Oceans, said:
Hon. Gail Shea, MP “Illegal fishing undermines
the livelihoods of legitimate fishermen around the world. By strengthening the Coastal Fisheries Protection Act, our government is protecting the livelihoods of Canadian fishermen and to supporting the international fight against illegal, unreported and unregulated fishing.”
