Pace of Regulatory Activity to Pick Up at EPA T
he U.S. Environmental Agency (EPA) is expected to finalize several high-profile
and controversial rules that had been delayed by the election, some by the end of the year and others early in 2013 and 2014. This includes final guidance on Clean Water Act juris- diction and a draft report on the impacts of hydraulic fracturing on drinking water. Some of the pend- ing regulations of interest to the metalcasting industry include:
• New power plants: EPA is work- ing on new source performance standards (NSPS) for greenhouse gas emissions from new power plants. Te Mercury and Air Toxics Standards (Utility MACT) for new power plants currently are being reconsidered. Te agency is on track to issue a final rule by
March 2013. Ozone: Plans to tighten the National Ambi- ent Air Quality Standards for Ozone were delayed in 2011. EPA plans to issue a proposed rule by
• NSPS rule for greenhouse gas emissions from refineries: As part of a settlement agreement, EPA pledged it would develop a NSPS rule to be finalized by November 2012. However, the rule has not yet been proposed.
