THE IMPROVE- MENTS TO THE PROPERTY SHALL BE CONVEYED WITHOUT WARRANTY OF ANY KIND IN "AS IS" CONDITION. THE WARRANTIES CONTAINED IN SECTION 55-70.1 OF THE CODE OF VIRGINIA ARE HEREBY EXCLUDED. The Property is conveyed SUBJECT TO conditions, restrictions, rights of way, easements, and reservations, if any, contained in the deeds forming chain of title thereto, filed and unfiled mechanics' and material¬men's liens, if any, and all other matters of record taking priority over the Deed of Trust, if any.


To the extent permissible by law, all bidders, including the successful bidder, waive and release the Substitute Trustee, the Noteholder, and their respective agents, successors and assigns from any and all claims such bidder or his successors and assigns may have now or in the future relating to the environmental condition of the Property, including any claims pursuant to the Comprehensive Environmental Response Compensation and Liability Act of 1980, as amended, and all other actions pursuant to state or local laws, ordinances, or regulations for any environmental condition of the Property.


Further information regarding the Property described herein and all documents available to the Substitute Trustee and affecting the premises may be examined by prospective purchas¬ers at the offices of the Substitute Trustee on Monday through Friday, inclusive, of each week (exclusive of legal holidays) between 10 a.m. and 4 p.m.


TERMS OF SALE: A deposit in an amount equal to the lesser of ten percent (10%) of the successful bid amount or in the amount of Thirty-Five Thousand Dollars ($ 35,000.00), by certified or cashier's check, must be delivered to the Substi¬tute Trustee immediately following the sale. The deposit of the successful bidder at the time of sale will be retained by the Substitute Trustee pending settlement, with the balance due within fifteen (15) days from the date of the sale. The deposit, without interest, shall be applied to the credit of the successful bidder at settlement; or, in the event of the failure to complete settlement within fifteen (15) days from the date of sale, the deposit shall be forfeited and applied to the costs and expenses of sale and the balance, if any, shall be applied against the balance of the debt including payment of the Substitute Trustee's compensation. TIME SHALL BE OF THE ESSENCE WITH RESPECT TO SETTLE¬MENT. It shall be the responsibility of the purchaser to obtain possession of the Property for himself.


Notwithstanding the foregoing, the Substitute Trustee reserves the right to waive the requirement of the deposit and to postpone settlement following sale for a reasonable period of time.


All costs of the conveyancing, which shall be by special warranty deed, examination of title, recording charges, notary fees, settlement fees, including preparation of deed and grantor's tax thereon, etc., to be at the cost of the pur¬chaser. Real estate taxes for the current year shall be adjusted to the date of sale.


In the event the Substitute Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, such notice of postponement or setting over will be announced in a manner deemed reasonable by the Substitute Trustee and in accordance with the Code of Virginia and the Deed of Trust.


Written notice of this Trustee's Sale, as required by Section 55 59.1 of the 1950 Code of Virginia, as amended, has been given to the present owner of the property described herein, by certified mail to their last known address, as such owner and address appear on the records of the Noteholder.
