Standard Rules Consternation No.21


IN January 2018, a consultation entitled “Proposals to tackle crime and poor performance in the waste sector & introduce a new fixed penalty for the waste duty of care” was issued, with the consultation response document issued in July 2018. We have already seen the impact of the consultation through the introduction of the requirement to note technically competent managers’ details on waste returns.


The consultation also proposed changing or withdrawing a number of waste exemptions, namely the D7, T4, T6, T8, T9, T12, U1, U16, S1 and S2.


The outcome of the consultation has resulted in new proposed standard rule sets for the T4, T8 and T12 exemptions. Changes to existing vehicle dismantling and metal recycling site permits are also proposed. The consultation is available online and focuses on three current exemptions:


● T4 - Preparatory treatments (baling, sorting, shredding etc)


PROPOSED RULE SET SR2019 No 6 for the T8


SR2019 No 4 for the T12 SR2019 No 5 for the T4


● T8 - Mechanical treatment of end-of- life tyres


● T12 - Manual treatment of waste


It should be noted that the introduction of the permits could mean that the current exemption limits will be revised and some may be withdrawn altogether.


The table below provides a rough summary of the proposed changes.


As with most consultations this one is likely to go through as suggested but the only way to impact upon the proposals if they significantly affect you is to respond.


Changes to several existing standard rules permits are also in the consultation:


● Standard rules sets SR2008 No 12 and SR2008 No 13 to allow household waste amenity sites to allow storage of 1 tonne of intact vehicle tyres and EWC 17 09 04 (Mixed C&D waste).

dismantling (authorised treatment) facility) will allow storage (no treatment) of up to 10 tonnes of intact catalytic converters. Removal of codes 16 01 07 (oil filters), 16 01 11* and 16 01 12 (brake pads).


● Revision to standard rules sets SR2008 No20, SR2011 No3, SR2012 No14, SR2015 No13, SR2015 No17 and SR2015 No18 to change the definition of 'waste motor vehicle' to “any motor vehicle that is waste within the meaning of Article 3(1) of the Waste Framework Directive” i.e. any substance or object which the holder discards or intends or is required to discard. The old definition relating to a vehicle used on land so the definition is now much broader, which I think could include trains and other motorised transport, although guidance is not yet out.
