MADE September 6th, 1984 COMING INTO OPERATION Seplember 23rd, 1984 The Minister of Agriculture, Fisheries afid Food, in exercise of the powers conferred by article 14 of the Sheep Scab Order


.1. This Order, which may be cited as the Sheep Scab (Infected Area) (No. 4) Special Order 1984, shall come into operation on September 23rd, 1984, and shall remain in force until midnight on November 3rd, 1984. DECLARATION OF INFECTED AREA 2. The area described in the Schedule to this Order is hereby declared to be an infected area for the purposes of the Animal Health Act 1981 (e) and Part IV of the Sheep Scab Order 1977 as amended. APPLICATION 3. The provisions of Part IV of the Sheep Scab Order 1977, as amended, shall apply in the infected area declared by this Order except that —


(i) in article 16 (2) (a) for the words "that they have all been dipped by or on behalf of the owner within the relevant period and within the previous 28 days and have subsequently been kept separate from undipped sheep" there shall be substituted the words "the sheep have all been dipped within the relevant period and within the previous 28 days or, in the case of sheep moved other than from an island off the Scottish mainland into a market or place of exhibition within the first 7 days of the relevant period, that they have all been dipped within the relevant period or within the 7 days preceding the relevant period or, in the case of sheep moved from an island off the Scottish mainland into a market or place of exhibition within the first 7 days of the relevant period, that they have all been dipped within the relevant period or within the 14 days preceding the relevant period and in each case that the sheep have subsequently been kept separate from undipped sheep." (ii) the prohibition imposed by article 15 (8A) shall not apply to sheep which are moved from any farm holding or agricultural premises in the infected area declared by this Order to any other farm holding or agricultural premises in that area for the purpose of being dipped thereon, or to their subsequent return to the farm holding or agricultural premises of origin.

DEPARTMENT OF TRANSPORT — LAND COMPENSATION ACT


1973 (AS AMENDED)


1. The Secretary of State for Transport hereby gives notice that the length of highway detailed in the Schedule below was first open to public traffic on September 14th, 1983, after comple­ tion of carriageway alterations.


2. Under Part 1 of the Land Compensation Act, 1973 (as amended) there is a right to compensation in respect of any


depreciation of more than £50 in the value of certain interests in land caused by the use of new or altered highways and resulting from specified physical factors (noise, vibration, smell, fumes, smoke and artificial lighting and the discharge on to the land in respect of which the claim is made of any solid or liquid substance). Compensation is assessed by reference to prices current at a date twelve months after the highway is first open to public traffic or, in the case of an altered highway, first open to public traffic after completion of the alterations.


'3. Interests qualifying for compensation are specified in section 2 of the above-mentioned Act and there are special provisions relating to claims by mortgagees and persons entitled under trusts or settlements.


4. Any person entitled to a qualifying interest who considers he has a claim under the said provisions may obtain further information and claim forms from the Director (Transport), the Department of the Environment and Transport at Sunley Building, Piccadilly Plaza, Manchester, M1 4BE. 5. Claims may be made twelve months after the date when the new or altered highway was first opened to public traffic, that is on or after September 14th, 1984 (the "first claim day"). Claims should be made within six years from this date. However, if an interest is disposed of or (insofar as the interest is in land which is not a dwelling) a tenancy is granted, the claims must be made before such disposal or grant of tenancy.
