DEPARTMENT OF TRANSPORT LAND COMPENSATION ACT 1973


1. The Secretary of State for Transport gives notice that the alterations to the A59 trunk road, at its junctions with the A671 Clitheroe Northerly By-Pass immediately south of Worston were completed on March 28th, 1978.


2. Under Part 1 of the Land Compensation Act 1973 there is a right to compensation in respect of any depreciation of more than £50 in the value of certain interests in land caused by the use of new or altered highways and resulting from specifield physical factors (noise, vibration, smell, fumes, smoke and artificial lighting and the discharge on to the land in respect of which the claim is made of any solid or liquid substance). Compensation is assessed by reference to prices current at a date twelve months after the highway is first open to public traffic or, in the case of an altered highway, first open to public traffic after completion of the alterations.


3. Section 2 of the above-mentioned Act specifies the interests qualifying for compensation. In general terms they are owners of houses, owner occupiers of farms and owner occupiers of other premises with a rateable value of not more than £2,250. A tenant or a lessee qualifies as an owner if his tenancy or lease has at least three years unexpired at the time of his claim. There are special provisions relating to claims by mortgagees and persons entitled under trusts or settlements.


4. Any person entitled to a qualifying interest who considers he has a claim under the said provisions may obtain further information and claim forms from the Regional Controller (Roads and Transportation) of the Departments of the Environment and Transport at Sunley Building, Piccadilly Plaza, Manchester. M1 4BE.


5. Claims may be made at any time during the two year period between the first and third anniversaries of the opening of the altered road, that is between March 28th, 1979 and March 27th, 1981 (the claim period). However, if during the claim period an Interst is disposed of or, (insofar as the interest is in land which is not a dwelling) a tenancy is granted, the claim must be made before such disposal or grant of tenancy.
