Story: EC considers ‘fairer sharing’ of burden of travel refunds We need to disentangle financial protection from the “proper performance” issue applying to operators by removing it from the Package Travel Regulations entirely. Any money paid in advance should be fully protected, whether it is paid to a tour operator or a carrier. That would require separate (simple but radical) legislation and mean that the UK department monitoring compliance would be BEIS and not Transport (DfT). It would also help to address the conflicts of interest which have meant that nobody is actually enforcing current legislation (except the CMA in its rather dilatory way) because to do so would give the DfT too many other problems with failing carriers.
