The amendments and extensions mentioned may have the consequence that more substances will now have to be indicated as mixture components in subsection 3.2.


It is also important that for substances indicated in subsection 3.2. the following additional data, if available, shall be provided: the specific concentration limit, the M-factor (multiplication factor for a substance classified as acute or chronic aquatic hazardous, category 1) and the acute toxicity estimate (ATE) value. This data is important for the classification of the respective mixture. Furthermore, information on the nanoform has to be provided, if applicable.


There are also various changes and additions in section 9 “Physical and chemical properties”. Subsection 9.1. “Information on basic physical and chemical properties” contains various changes to designations and additions to the properties to be listed, for example the new property “Particle characteristics” for solids, and subsection 9.2. “Other information” has been restructured and substantially extended.


In Section 12 “Ecological information” a new subsection 12.6. “Endocrine disrupting properties” is introduced and, finally, Section 14 “Transport information” contains several amendments, for example a new heading for subsection 14.7. for Maritime transport in bulk according to International Maritime Organisation (IMO) instruments.


The explanations clearly demonstrate that the new SDS format contains a wide range of changes and additions. For detailed information please refer to the Regulation (EU) 2020/878 and the updated guidance of the European Chemicals Agency, ECHA, on the compilation of SDSs, Version 4.0, December 2020.


When does the new format apply and is there a transition period? The new format applies from 1 January 2021. However, SDSs complying with the previous format according to Regulation (EU) 2015/830 may continue to be provided to customers until 31 December 2022, so there is a transition period of 2 years.


Is it a requirement that SDSs should be updated for products where no new data is available? Yes, all SDSs have to be adapted to the new format,


since in addition to extended data requirements, there are also new subsections, and new and amended subheadings. As it is well known, SDSs must contain all sections and subsections with the specified designations according to the regulation, with the exception of subsections 3.1. for substances and 3.2. for mixtures.
