Energy Taxation Directive into review


In the past months UEIL was asked by the European Commission to share its views on the Energy Taxation Directive. UEIL submitted its views on the Directive to a questionnaire circulated by Deloitte, the results of which will be amalgamated in a report.


For long, UEIL has been following the debate on the Energy Taxation Directive, as the ‘92 Directive explicitly exempted mineral oils used for purposes other than as motor fuels or heating fuels from excise duty. The debate on whether or not to exempt mineral oils not used as fuels was re-opened in 2003, and the exemption was no longer stated in the current Directive. Although currently only 4 countries apply a specific national excise duty on lubricants, UEIL calls on the Commission to provide a specific exemption for lubricants, as it creates serious distortions on the internal market and undermines the principle of a level playing field within the lubricant sector.


Fiscal Issues


The Commission is reviewing its Energy Taxation Directive that was withdrawn by the Commission in 2015 as there was no agreement among the EU Member States on the way forward of this Directive and the Commission hired an external agency to prepare a technical study. UEIL will provide its input to this external agency and will highlight that through the inclusion of lubes within the Directive but with an specific exemption as was the case in the previous directives 92/12/EC, 92/81/EC and 92/82/EC a real level playing field can be achieved.

Since the last Newsletter no OEM Bulletins have been released, however it is envisaged that several new OEM Bulletins will be issued over the next few months. The Technical Committee is currently investigating: • Industrial 1 Case • Off Highway 9 Cases +

(3 cases have been transferred to the CC) 5 Cases +


(4 cases have been transferred to the CC) 1 Cases +


(2 cases have been transferred to the CC) • Two Stroke 0 cases + (2 cases have been transferred to the CC)


The next Technical Committee meeting will be held in Brussels on 20 September 2017.
