BIFA links with Drewry to provide value-added service for Members


Forwarder freight rate benchmarking BIFA is pleased to announce a collaboration to make Drewry’s confidential freight rate benchmarking service available to Members. Drewry Forwarder


Benchmarking Club, which has been designed to meet the specific needs of freight forwarders and non- vessel operating common carriers (NVOCCs), provides Members with the opportunity to confidentially benchmark their ocean carrier buy rates against their peers.

When does the CMR or Montreal Convention apply?


A judgment regarding the CMR convention has been made in Germany involving an airfreight consignment from the US to Germany. (See also page 12) The consignment was


transported by air to a transhipment warehouse at Frankfurt Airport where it was due to be transported to its final destination, but could not be located in the warehouse. The claimant refused to settle

The Hamburg state court stated that German law did not apply in this case, and that the Montreal Convention was applicable. The ruling clearly stated that the convention applied until the loading of the collecting vehicle was completed. Therefore, as the loss had occurred before this point, all claims should be settled under the convention’s terms. The decision was based upon


Article 18 (4) (1) of the Montreal Convention, which states that the period of carriage by air does not include carriage by land, sea, or inland waterways outside an airport. This means that the convention does apply whilst the cargo is being stored at an airport, and thus liability is limited to 22SDR per kilo.

By road – CMR (8.33 SDR): £9.19 per kg
