Basic Conditions of Employment Act
No. 75 of 1997 (BCEA)
Purpose:
• Applies to all employees and employers except: o senior management o sales staff who travel o employees who work for less than 24 hours a month o unpaid volunteers working for a charity
o National Defence Force, National Intelligence Agency and the South African Secret Service
Labour Relations Act No. 66 of 1995 (LRA)
Purpose: Regulates dispute resolution and the rights of employees and employers in the workplace
Consumer: Advantages
• Promotes responsible consumer behaviour • Facilitates return of goods and guarantees money back
• Protects consumers from misleading advertising • Allows a five-day cooling-off period for purchases made through direct marketing
• Simplifies contracts • Specifies consumer rights and responsibilities • Allows a six-month period to return or claim refunds for defective purchases
Business: Disadvantages
• Costs time and money to implement processes and procedures
• Allows consumers to easily cancel contracts • Increases costs of indemnity insurance • Limits direct marketing
Compliance and penalties Consumer: Disadvantages
• Lists requirements a customer must meet in order to buy on credit
• Limits sales offerings due to restrictions by the Act Compliance and penalties

Business: Advantages
• Prevents larger businesses from taking advantage of smaller businesses
• Protects competition creating a better market environment
