Notice of Ontario Court of Justice Decision
On June 7, 2017, Peter’s Drive-In Cleaners Ltd., was convicted in the Ontario Court of Justice in London, ON of two counts of contravening the Tetrachloroethylene (Use in Dry Cleaning and Reporting Requirements) Regulations (the “Regulations”), paragraph 8(1)(b) which constitutes an offence under the Canadian Environmental Protection Act, 1999 (the “Act”), paragraph 272.2(1)(f). Peter’s Drive-In Cleaners Ltd. was fined $4,000 for each offence. Barbara Jovanovic, an owner of Peter’s Drive-In Cleaners Ltd., was convicted of one count of contravening the Regulations, paragraph 8(1)(a) which constitutes an offence under the Act, paragraph 272.1(1)(f), and she was fined $2,000. The $10,000 in fines will be directed to the Environmental Damages Fund.
The Act and the Regulations are in force to reduce the release or potential for release of tetrachloroethylene into the environment. Environment and Climate Change Canada is responsible for enforcing the Act and the Regulations and routinely inspects dry-cleaning facilities to ensure that facilities are in compliance.
Non-compliance may result in a prosecution.
Peter’s Drive-In Cleaners Ltd. no longer uses tetrachloroethylene in its operations and has not since Summer 2016.
