At present, there are currently an estimated 600 illegal waste sites operating in England, Wales and Northern Ireland. T e Environment Agency already has the power to shut them down, due to the damage they cause to the environment. In 2016, it prosecuted 110 businesses and individuals for off ences related to illegal waste sites.


Historically, when operators are fi ned for breaching environmental regulations, the fi nes oſt en do not match the profi ts derived from the illegal activity.


In its consultation document, HMRC provides an example of how the new legislation would change this: “In 2016 three people were charged for illegally dumping 6,000 tonnes of waste. T e fi nes levied through environmental legislation totalled £170,000. If the illegally dumped material had been liable to Landfi ll Tax, it would have resulted in a tax bill of more than £500,000, plus a penalty of up to 100% of the tax, and interest. In this scenario, it could have resulted in the illegal waste site operator facing a tax liability of over £1 million.”


DETERRENT


Paul O’Neill, a Landfi ll Tax expert and director of Environmental Tax Advisory Services Ltd, welcomed the move by the government to increase the penalty for tax evasion and said it was not surprising as it mirrored rules already in place in Scotland and Wales. However, he warned that its impact may not be as big as some might wish.


He said: “As well as being a blight on communities, unpermitted landfi ll sites mean that legitimate landfi ll businesses are not operating on a level playing fi eld so the new legislation should encourage the regulated and responsible disposal of waste. It should, in theory, close the landfi ll gap which was reported to be £150 million in December 2016.”


“However, collecting taxes from the shadow economy is notoriously diffi cult so it will be interesting to see how much of a deterrent to illegal landfi ll site operators the new legislation is. T us, we would encourage the Government to properly fund the enforcement arms of both HMRC and the Environment Agency to ensure that they have suffi cient resources to tackle the problem.”
