2015: A Year of Success for NATM in Washington, D.C. Tracks


pay a civil penalty of $200 million. That action came shortly after Fiat-Chrysler became the fifth vehicle manufacturer penalized for failure to meet early warning reporting requirements. NHTSA assessed a $70 million penalty in that case. This pattern of enforcement can be expected to continue as the highway bill extension enacted into law in December authorized additional funding for NHTSA to audit manufacturer compliance with early warning requirements.


Recognizing the enforcement pattern as well as the importance and complexity of the relevant laws, NATM worked with K&L Gates to develop a compliance guide to assist its members in understanding their obligations under federal law and regulation. The guidebook provides summaries and real-world examples of situations that trailer manufacturers may face and how they should respond. While all situations are different and manufacturers should seek independent legal advice in recall and


reporting matters, the guidebook is an educational resource that will be of significant value to the industry.


The successes of 2015 are a testament to the hard work and vision of NATM’s leadership, which decided several years ago to embark on a pro-active strategy of engaging with government. Moving forward, NATM plans to remain vigilant on behalf of its members since Congress continues to propose legislation and agencies continue to pursue regulations that could affect the industry.
