Did the Circuit Court err in refusing to declare the Hagerstown Adult Business Law unconsti- tutional as a prior restraint on the freedom of speech which does not implicate a significant state interest and is not narrowly drawn so as to render any incidental restriction upon Freedom of Speech no greater than necessary? This case is a constitutional challenge under Article 40 of the Maryland Declaration of Rights to licens- ing and operational restrictions imposed by the City of Hagerstown on Adult Book & Video Stores.

Did the Trial Court err in granting the defen- dants’ motion for judgment where the plaintiff suffered a heart attack, but was not timely trans- ported to the hospital for treatment, given the Trial Court’s holding that the plaintiff may have died, in any event, because there is no guaran- tee that the hospital would have saved his life? The plaintiff produced expert testimony to the effect that within a reasonable degree of medi- cal certainty, if the plaintiff had been taken to the hospital earlier, he would have survived his cardiac arrest. The issue on appeal is, in essence, whether such testimony is sufficient to create an issue for the trier of fact.
