TMA, AMA support Sunshine Act Open Payments reporting exclusion


TMA AND the American Medical As- sociation want to ensure certain edu- cational programs and materials are excluded from Open Payments System (tma.tips/GetStartedOpenPayments) reporting. In a letter, TMA, AMA, and dozens of medical organizations and specialty societies assert their support for HR 293 by Texas Congressman Mi- chael C. Burgess, MD. nent the current regulatory exemption for independent continuing medical education. Medical textbooks and journal reprints would be added to the list of exempt transfers of value. The letter states the Centers for


Medicare & Medicaid Services has concluded in its interpretation of the Sunshine Act “that medical textbooks, reprints of peer reviewed scientific clinical journal articles, and abstracts of these articles are not directly bene- ficial to patients, nor are they intended for patient use. This conclusion is in- consistent with the statutory language on its face, congressional intent, and the reality of clinical practice where patients benefit directly from im- proved physician medical knowledge.” The letter concludes: “The Sun-


shine Act was not passed to limit or construct additional barriers to the dissemination of new medical knowl- edge that improves patient health outcomes. HR 293 is needed to ensure patients benefit from the most up-to- date and relevant medical knowledge.”
