Every month, we read countless tales of companies facing prosecution for failing to protect the wellbeing of their workers. Thankfully, these incidents aren’t as common as they once were but, as we know, just one injury or fatality at work is one too many.


The most serious of cases can now end up in court under the Corporate Manslaughter and Corporate Homicide Act. Only introduced in 2007, the Act is still relatively untested and has only been applied to a handful of cases so far.


It’s so new, in fact, that the Sentencing Council has recently released further draft sentencing guidelines for public consultation. This was triggered, in part, by calls for higher financial penalties for those companies found guilty of an offence under the 2007 Act.
