FINED OVER £150K Chessington World of Adventures has been fined over £150,000 for safety failings that led to a four-year-old girl suffering life-changing head injuries.
The child, from Kent, fell nearly four metres while waiting in line for the Tomb Blaster ride with her family at the theme park on 7th June 2012. She suffered a fractured skull, bleeding to the brain and broken ribs and was in hospital for a month. She still needs extensive rehabilitation treatment and specialist support.
HSE discovered that a rotting paling in the fence had fallen out on the morning of the incident, having been dislodged, and that the whole fence showed evidence of serious weakening.
The investigation revealed the fence palings were found to have evidence of white and brown rot. There was also evidence that numerous palings
had been re-fixed over the years, demonstrating a recurrent problem.
HSE told the court that an adequate maintenance regime would have captured details of regular repairs and identified trends. But without these, management were unable to see any pattern developing and were therefore unable to address it properly.
WORKER FELLED BY FALLING METAL BEAM
Two firms have been sentenced after a metal beam fell from the 6th floor of a building, striking a worker on a 3rd floor scaffold before crashing onto a busy street in the City of London.
The 32kg beam hit a 38-year-old worker while he was on an access platform, breaking six ribs and fracturing three vertebrae. The man was in hospital for a week and unable to work for two months.
HSE found that John Doyle Construction, a sub-contractor on the project, failed to implement reasonable control measures to prevent any beam from falling in that way. Principal contractor, McClaren Construction also failed to identify that controls were lacking.
McClaren Construction was fined over £35,000 including costs. The court indicated that had the firm not been in liquidation, a £50,000 fine would have been imposed on John Doyle Construction.
