‘Conscious uncoupling’ or good old fashioned D.I.V.O.R.C.E…
…Whatever you call it, sometimes relationships reach a natural (or untimely) end and it’s time to go your separate ways. If that time arrives, what are the grounds on which proceedings can be instigated?
To obtain a divorce one party needs to formally issue proceedings against the other. To obtain a divorce you need to be able to prove that your marriage has broken down irretrievably through one of the following:
1. 2.
3. 4.
5. Your spouse has committed adultery and you find it intolerable to continue living together.
Your spouse has behaved in such a way that it would be unreasonable to expect you to continue living together.
Your spouse has deserted you for a continuous period of two years or more.
You and your spouse have been living separately for two years or more and your spouse agrees to the divorce.
You and your spouse have been living separately for five years or more whether or not your spouse consents to the divorce.
Our Family Law Team has been recognised by the Legal 500 (a who‟s who of the legal profession) and is committed to promoting a non-confrontational approach to family and matrimonial problems. We encourage solutions that consider the whole needs of the family especially the children.
We can also advise on what factors will be taken into account when dealing with Finances. Wherever possible we try to resolve issues without going to Court… but if necessary we will be able to give clear advice on what the Court would likely order if it were to be involved.
