have been obtained by DMR since 2008 which along with refi nements in our sea sampling data allow a more rigorous ana- lytical approach to be conducted than what was done for the MSC assessment. The Department will strongly urge the New England Fishery Management Council to support additional work to better under- stand the interactions between the lobster and groundfi sh industries before taking any management actions and recommend that additional analysis be completed by the New England Fishery Management Council in cooperation with the Atlantic States Marine Fisheries Council Lobster Technical Com- mittee. In addition, the DMR will request that the New England Fishery Management Council not take any future management


action affecting the lobster fi shery without consulting the Atlantic States Marine Fish- eries Commission and its Lobster Manage- ment Board.


The Department of Marine Resources will be scheduling conversations with both the lobster and groundfi sh industries as this issue moves forward.

necessary time to conduct a more rigorous analysis of available data. Today’s decision also addresses jurisdictional issues by en- suring involvement of the Atlantic States Marine Fisheries Commission in the data analysis and on-going management discus- sions.


The Council clearly also recognized the point I have already made in a previous statement that the number of cod published by the Press Herald as by-catch was a rough estimate derived by the Marine Stewardship Council in 2008 from raw data. Because it is such rough estimate, it has no place in the discussions about management measures. I will continue to support efforts to ac- quire and analyze appropriate data to ensure that a thorough assessment of cod by-catch in the lobster fi shery occurs. Patrick Keliher


Notice of DMR Public Hearing Re- garding Fishing Industry Impacts of Berth Maintenance Dredging Project at Sprague Terminal in Searsport, Maine Pursuant to 38 M.R.S. §480-D, sub-§9, the Maine Department of Marine Resources (DMR) is required to provide the Maine De- partment of Environmental Protection with an assessment on the impacts on the fi shing industry of a proposed dredging operation. Sprague Operating Resources LLC of Portsmouth, New Hampshire has submitted a Natural Resource Protection Act (NRPA) permit application to dredge primarily silt, sand and gravel material from the berthing


area at the Sprague Marine Terminal liquid and bulk docks in Searsport. The dredged material (13,100 yds.) would be disposed of onshore for benefi cial fi ll use on the Sprague property. This project does not include the dredging of the navigation channel proposed by the Army Corps of Engineers. As allowed under this section, the Department of Marine Resources (DMR) originally determined not to hold a public hearing on this proposal in its notice pub- lished on October 16, 2014 in the Bangor Daily News. This was determined due to the minimal amount of dredged material, the immediate upland disposal of dredge spoils, and no anticipated impact to fi shing in the area. Additionally, the DMR has requested the use of an environmental bucket dredge in order to minimize re-suspension of dredged material for this operation. Having received written notice from fi ve or more persons requesting a public hearing, DMR will hold such a hearing as required per 38 M.R.S. §480-D, sub-§9.


The DMR will conduct this required hearing and receive testimony about the above dredging project at the Searsport High School gymnasium at 24 Mortland Road in Searsport on Monday, December 8, 2014 at 6 p.m.
