TheACOPand guidance give practical advice on the Gas Safety (Installation and Use) Regulations and is required reading for anyonewhomay have a duty under the Regulations. In December the Leashold Reform (Amendment) Bill passed through itsCommittee Stageinthe House of Commons. It returnsfor its ReportStage laterinJanuary. Theprivatemembersbillhas beenintroducedbyDavid Nuttall MP(BuryNorth)supported by Seddons solicitor John Midgley (a regular contributor to Flat Living) on behalf of the Association of LeaseholdPractitioners (ALEP). Theproposed legislationseeks
to abolishthe need forindividual tenants to signnotices personally, underthe provisions of Sections 13 and42ofthe 1993 Leasehold ReformHousingand Urban
DevelopmentAct.Instead,the
Bill callsfor theright forsolicitors or someoneelsedulyauthorised on tenants’ behalf (suchasan attorney)tosignthe notices. As thelaw stands at present, this is notpossible forsigning section13or42Notices.Ifthe tenant cannot signpersonally, no claim foralease extension canbemade and, in thecaseof acollectiveenfranchisement forthe acquisitionofafreehold, itmaybeprejudicialtogetting asufficientnumberofpeople involved. This is inconsistent with the
fact that landlordsmay have their solicitors sign Counter Notices (under the1993Act). It is also
different to the tenant’s position with regard to the signing of Notices for the enfranchisement of houses under the Leasehold Reform Act 1967. If adisabledtenanthas given
apower of attorney to athird party, that attorney cannot sign the notice. There are also difficultieswhen it comes to the signing of notices by companies and often inconvenience and delaywhenitcomes to getting notices signed by tenantswho are based overseas. The proposed Bill enhances tenantsrightsand is a form of deregulation; something that ALEP has been pursuing for sometime.
