FEDERAL LITIGATION SECTION


The Federal Litigation Section continues to be actively involved in liaison on behalf of the Law Council with Federal Courts and Tribunals.


Having enjoyed an extremely valuable and productive liaison relationship with the former President of the Administrative Appeals Tribunal, the Hon. Justice Garry Downes, the Section’s AAT Liaison Committee and Commonwealth Compensation & Employment Law Committee have already established regular and productive liaison with the new President, the Hon. Justice Duncan Kerr.


The Hon. Justice Downes was a tremendous supporter of the activities of the Section and in particular has Chaired all but one of the regular Hot Topics in Commonwealth Compensation seminars conducted by the Commonwealth Compensation & Employment Law Committee.


The Section is extremely pleased that the Hon. Duncan Kerr is likewise making his valuable time available to Chair the next Hot Topics event, to take place in Sydney on 7 December 2012.


The Section’s Federal Court Liaison Committee also continues its longstanding and active liaison relationship with the Federal Court.


As previously reported a signifi cant achievement of this Federal Court liaison saw the production and launch of the Federal Court of Australia Case Management Handbook in October 2011. The Handbook was the culmination of more than 12 months’ collaboration with the Court, and a draft of the Handbook formed the basis of discussion at a joint Law Council and Federal Court workshop conducted in Melbourne in August 2011.


The Handbook continues to be a work in progress, with an Editorial Committee having been established to keep it up to date. Additional chapters will be added over time on general topics including areas such


as representative actions, ADR, Fast track, Discovery of Facts, Interlocutory applications and submissions. The Handbook can be downloaded from the Law Council website, and we recommend the Handbook to all users of the Federal Court.


The Section has written to the State & Territory Bar Associations suggesting that the Handbook may usefully be included in readers’ course materials. A number of the Bars have already replied, with encouraging responses indicating that this would be considered.


Continuing the theme of liaison with Federal Courts and Tribunals, the Section is in the process of re-establishing a Federal Magistrates Court Liaison Committee. The role of this important Committee will be to conduct regular liaison with the General Federal Division of the Federal Magistrates Court on issues of practice and procedure in the Court. The Committee will include representatives from the Business Law Section and the International Law Section.
