Criminal Law In addition to these three main categories of offenses, an


individual convicted of a particularly serious crime may be barred from applying for asylum, an individual convicted of two misdemeanors or a felony can be barred from extending or applying for temporary protected status, and criminal conduct can bar an individual from applying for citizenship which requires a showing of good moral character within the five years preceding the application.


Criminal Activity Triggering Inadmissibility Individuals who are deemed “inadmissible” are ineligible


to receive visas and ineligible to be admitted into the United States.4


Inadmissible foreign nationals include anyone who:


• has been convicted of, admits having committed, or admits to acts comprising essential elements of a crime of moral turpitude;


• has been convicted of, admits having committed, or admits to acts comprising a violation of law relating to a controlled substance;





has been and illicit trafficker of a controlled substance, has aided or abetted a controlled substance, or is the spouse, son, or daughter of a drug trafficker who has

obtained financial benefit from the illicit activity within the past five years and knew or should have known that it was the benefit or product of such activity;


is coming to the United States to engage in (or within 10 years of applying for admission has engaged in) prostitution or another form of commercialized vice;


committed a serious crime for which diplomatic immunity or other form of immunity was claimed;


commits, aids or otherwise furthers severe forms of human trafficking, or is the child or spouse who has benefitted from proceeds of illicit activity while an adult in the past five years;


• is engaging or seeks to enter the United States to engage in money laundering;


seeks to enter the United States to engage in espionage, sabotage, export control violations, unlawful opposition to government, or other unlawful activity.5


A few of the grounds of inadmissibility qualify for waivers,


including crimes involving moral turpitude where the maximum possible sentence is less than one year and the sentence imposed is less than six months; single offense of simple possession of 30 grams or less of marijuana; among others.6
