an application to practice optometry from their home office. Appellees were granted an exception to the residential zoning ordinance. Appellants appeal the Circuit Court’s decision in holding that the Board of Appeals had an obligation to consider restrictive covenants in the neighborhood in reaching a decision to grant the special exception in this case.

Tis case involves the double conveyance of a parcel


of land. Tis appeal stems from a lawsuit filed the by the Appellees against the Appellants. Te questions presented on appeal are: (1) whether the Circuit Court erred in finding that the Appellee had a cognizable negligence claim for breach of any duties owed to them; (2) whether the Circuit Court erred in finding that the Appellee satisfied its burden of proof for the elements of the negligence claim; and (3) whether the Circuit Court erred in finding the Appellants vicariously liable. 
