Uninsured Motorist Claim/ Worker’s Compensation Benefits

McGuckian/ Montgomery County Baltimore County

Did the Circuit Court err in finding that the total recovery by the wrongful death beneficiaries was limited to $20,000 because they did not reside in the insured’s home on the date of the accident and because of the household exclu- sion in the subject automobile and umbrella policies?

Did the trial court err in asking a question about insurance coverage and in allowing the Defendant’s driving record to be introduced into evidence?

Did the trial court err in granting GEICO summary judg- ment ruling that §19-513 of the Insurance Code reduced all benefits due the Plaintiff (liability coverage and UM) by the amount of worker’s compensation benefits paid? Plain- tiff argues that only the recovery from the liability coverage should be reduced.

Does Maryland’s one-year statute of limitations start when the appellant discovers defamatory statements published by Defendants? Were Defendants protected by a qualified privilege under § 5-423 of the Courts & Judicial Proceed- ings Article, and if so, does Appellant/Plaintiff have the right to produce evidence to overcome that privilege?

Was the claimant required on appeal to present evidence to the jury on the issue of causal relationship if the Worker’s Compensation Commission found no accidental injury in the course of employment?

In this case a two-year old, who was left unattended in a motor vehicle by a daycare provider, died as a result of heat prostration. Did the trial court err in granting summary judgment to Allstate Insurance Company holding that the subject policy’s family daycare endorsement provision le- gally excludes claims for a daycare provider’s negligence?

Did the trial court err in affirming the Commission’s rul- ing that the claimant, a Montgomery County correctional officer, sustained an accidental injury in the course of his employment when, after completing his shift for the day, he was injured playing basketball at the detention center’s gymnasium?
