New Laws Effective October 1, 2001
1. Parent Child Immunity - CJ 3-904 has been amended and CJ 5-806 has been added.␣ These changes abrogate parent child immunity in motor tort actions up to the limits of mandatory minimum coverage ($20,000/$40,000).␣ These provisions apply to any suit filed on or after October 1, 2001 and thus apply to motor vehicle incidents that occur before that date so long as suit is filed on or after October 1, 2001.
2. Required Notice to Mass Transit Administration - Modifies TR 7-702 to require written notice to the Mass Transit Administration within one year of the occurrence of an injury as a condition precedent to bringing suit.␣ This provi- sion is analogous to the notice requirement in the Maryland Tort Claims Act.
3. 10-104:␣ Out of State Health Care Providers - CJ 10-104 has been amended retroactively to apply to out-of-state health care providers as well as in state health care providers.
