Verdict/Settlement: The trial was bifur- cated on liability only based upon an agreement reached by the parties that any Defendant found liable would pay their policy limits without contesting Plaintiff ’s injuries or damages. $365,000 contin- gent upon at least one defendant being found liable. The jury found Defendant Benson re-


sponsible for the collision. Defendant Almodovar was found not responsible.

Special Remarks: Although the collision occurred in Montgomery County, Plain- tiff filed in the U.S. District Court for the District of Maryland because Plain- tiff was a resident of Virginia and diversity jurisdiction existed. Plaintiff was able to stack several UM policies issued to her and other family members living in the same household Although GEICO disputed the amount of UIM coverage available to Plaintiff, it did not otherwise participate in this matter with regard to the UIM claim.

Facts: While riding a Harley Davidson motorcycle, Plaintiff collided with the defendant’s Ford Mustang.


Defendant


failed to yield the right of way while mak- ing a left turn.


Allegations of Liability: Negligent driv- ing and failure to yield right of way.


Injuries and Damages: Plaintiff ’s right knee suffered serious injury requiring 3 surgeries over a 5-year period. Plaintiff suffered from an aggravation of an undis- puted pre-existing lower back problem at L4-L5, L5-S1. Various soft tissue inju- ries with residual effects to the neck, right shoulder and elbow. Past medicals $60,200, no lost wages, no future medicals.
