“This will allow TDI to better identify those networks or third-party payers in the market who incorrectly portray a physician’s network participation and levy appropriate fines or penalties when necessary. This will go a long way in making the advertised networks cred- ible and help patients know when physi- cians who care for them are truly net- work physicians and not be surprised by unexpected out-of-pocket costs.” A TDI spokesman told Texas Medicine those rules are “in the works,” but had no further comment.

Texas enacts strict abortion measure


In July, Gov. Rick Perry penned his name to a measure that bans abortions at or after 20 weeks postfertilization and subjects physicians to stiff penalties for violating the law, which passed despite concerns from the Texas Medical Asso- ciation and heated debates that dragged the issue out into two special sessions. House Bill 2 includes those abortions


in the Texas Medical Board’s list of pro- hibited practices by physicians or license applicants and assesses administrative penalties for physicians distributing or prescribing abortion-inducing drugs in certain situations. The law restricts use of RU-486, an abortion-inducing drug approved by the U.S. Food and Drug Administration for use by women who seek an abortion; requires that abortion providers have hospital privileges; and requires abor- tion facilities to meet ambulatory surgi- cal center standards. TMA did not take a position in the abortion debate, but raised concerns with the legislative intrusion into the patient-physician relationship and the practice of medicine and with a legisla- tively created standard of care. “This bill includes determinations that should be made by the medical commu- nity and science, not by the legislature,” TMA President Stephen L.
