Agents and brokers play a critical role in helping clients identify exposures and communicating with insurers about them.


Our customers and our brokers need to really understand and be able to relay to the risk carrier what they are taking on contractually.

Agents and brokers should help their healthcare clients carefully examine their policies to ensure they are covered for new exposures arising from healthcare reform.


The following exposures are of special concern:


• The transmission of electronic patient data – protecting its privacy and ensuring its accuracy to avoid medical errors.


• Liabilities created by virtue of the contracts with other healthcare entities.


• The incorporation of quality standards and how they impact payments.


Until the federal government issues definitive regulations, however, the ability of insurance producers to advise clients about managing their risks will be hampered by uncertainty.
