Exclusions and limitations
1. The Guarantee given by Cantifix is strictly subject to the provisions and limitations on the
liability of Cantifix, set out in the Contract and also to :-
a) a claim being received by Cantifix in writing within the relevant Time Limit as
specified in the guarantee document and such claim specifying the nature of
the claim and the date of the Contract;
b) regular maintenance of the component parts by the customer;
c) a claim not being made, which occurs outside the relevant Time Limit.
2. The relevant Time Limits shall run from the date of delivery of the order.
3. If a claim is properly made within the relevant Time Limit, Cantifix shall use its best
endeavours at its option, to either (a) replace the Component part free of charge, or (b)
refund such amount of the price as the Customer has paid to Cantifix (excluding
transport).
4. Cantifix shall be given a reasonable period of time from the date of the written notice of
claim to comply with any obligations it may have under this Guarantee.
5. If any part of this Guarantee is deemed invalid, illegal or unenforceable in any respect,
the validity, legality and enforceability of the remaining provisions shall not in any way be
affected or impaired thereby.
6. This Guarantee is deemed to be part of the Order and the Order and this Guarantee will
be construed as a single document. Without limiting the generality of this clause, any
limits on or exclusions of liability of Cantifix contained in the Order, will also apply for the
purposes of this Guarantee.
7. This Guarantee shall be issued in favour of the Customer or as directed by the Customer.
