Lancashire County Council Highways Act 1980 - Section 47

Proposal To Declare a Public Highway To Be No Longer Maintainable At Public Expense - Alma Place, Clitheroe.

Pursuant to the Highways Act 1980 Section 47, the Magistrates Court lor the petty sessional division ol Ribble Valley, acting by 3 magistrates being members ot the Court, has viewed the hiahwav known as Alma Place, Clitheroe, (O N T H E APPLICATION OF TH E LANCASHIRE CO UN TY COUNCIL), and is ot the opinion that there is ground tor the applications: and the application is that so much ol the highway, being a total area of 213 square metres, is unnecessary tor public use and therefore ought not to be maintained at the public expense.

The Court is of the opinion that the application ought to be proceeded with.

The purpose of the proposal is to de-adopt the area so as to remove design constraints on surfacing materials and street furniture. The public right of way is to be maintained albeit in a

different configuration.

A copy of the Map showing the proposal may be inspected free of charge at all reasonable hours, at my offices and at the offices of the Ribble Valley Borough Council, Council Oltices, Church Walk, Clitheroe. until the date ot the Hearing.

NOTICE IS HEREBY GIVEN that on the 7th day of December 1993 at 9*45 a.m. the court sitting at the Court House, King Street. Clitheroe, will be prepared to hear all persons objecting to such highway being declared unnecessary and not

maintainable at the public expense. G A JOHNSON Chiel Executive/Clerk Christ Church Precinct
