CONDITIONS OF ACCEPTANCE OF ALL ADVERTISEMENT ORDERS


Orders for insertion of advertisements in the Clith­ eroe Advertiser and Times are accepted subject to the Standard Condition agreed between the News­ paper Society and the Institute of Practitioners in Advertising save that.


-1. The proprietors accept no liability for any loss or damage caused by an e r ro r or inaccuracy in the printing of any advertisement.


2. No lia b i l ity is accepted for any loss or damage alleged to arise through delay in forwarding replies to box numbers, however caused. Particulars of the Standard Conditions will be supplied on request.


3.


I f the material or layout of the advertisement, or any part of it is composed by the Proprietors at no extra charge to the advertiser, the copyright in the whole advertisement shall belong to the Proprietors. .


4. The following rules for the settlement of accounts will apply:


(a) The due date for payment shall be the last day of the month following the month of insertion of an adver­ t is em e n t o r i f the p u b lis h e r s h a ll not have despatched the appropriate invoice and voucher or other proof of insertion (or made the same available for collection when this is the custom) to the agency (or the advertiser if it is a direct account) by the 10th day of the month following insertion, the last day of the second month following the month of insertion:


(b) I f any sum owing by the Agency (or the Advertiser if i t is a direct account) to the Publisher has not been despatched to the Publisher on or before the due date for payment the sum so owing shall immediately and without notice be increased by a surcharge equal to 3% of the gross rate charged by the Publisher before deduction of any Agency commission:


(c) I f any sum owing by the Agency (or the Advertiser i f i t is a direct account) to the Publisher (including the amount of any surcharge payable in accordance with paragraph (b) above) has not been despatched to the Publisher before the expiration of one month after the due date for payment the sum so owing shall immediately and without notice be increased by an additional surcharge equal to 2% of the gross rate charged by the Publisher before deduction of any Agency commission:


(d) The existence of a query on any individual item in an account w ill not affect the due date of payment of the balance of such account.


(e) In these conditions the word despatched shall mean despatched by post or by such other means as shall provide that payment shall have been received by the publisher not later than three working days from the date appropriate thereto.


(f) A l l advertisements are subject to 15% VA T . (g) A l l transient advertisements are subject to a 25% surcharge i f not paid within 14 days from the date of the invoice.


5. The terms of the Recognition Agreement between the Newspaper Society or between the Newspaper Society and the Newspaper Publishers Association and recognised advertising agencies are deemed to1 be incorporated in these conditions of acceptance of advertising orders or the publication of all advertise­ ments accepted from a recognised a dve r t is ing agency: Without prejudice to the generality of these terms these conditions of acceptance specifically extend to any personal guarantee given by the Directors or! any other person on behalf of a recognised agency at the time of the recognition in respect of any unsatis­ fied liabilities of the agency in the event of the agency’s liquidation or insolvency. Such guarantee is part of these conditions of acceptance.


6. The placing of an order for the insertion of an adver­ tisement shall amount to an acceptance of the above conditions and any conditions stipulated on an agency's order form or elsewhere by an agency or an advertiser shall be void insofar as they are in conflict with them.
