Everybody should set up Lasting Powers of Attorney (LPAs)! This is a bold statement but it is what the government has been saying since they introduced them in 2007. If you wait until you have a stroke or start to show signs of dementia, it might be too late: you need to ‘have capacity’ in order to set up an LPA. Without LPAs in place your family will find it very difficult if capacity is lost as they would have to apply to the Court of Protection and that is a slow and expensive process.


The Office of the Public Guardian is even offering a DIY version through their web site, www.gov.uk/power-of-at- torney/make-lasting-power. Of course not everyone has access to the internet and a lot of people are nervous about legal documents – rightly so as it is very easy to get it wrong.
