that the owner’s duplicate copy of Transfer Certificate of Title No. T-35366 and Transfer Certificate of Title No. T- 35367 be declared as lost and hence, null and void, and as a consequence, the Registry of Deeds of the Province of Negros Oriental be directed to issue a new owner’s duplicate copies thereof, with the same terms and conditions as the original ones, and which shall, in all respects, be entitled to like faith and credit, after payment of the fees prescribed by law. Petitioner alleges that she is one of the absolute and registered co- owners of Lot No 2881-C with an area of 2,610 square meters and covered by Transfer Certificate of Title No T-35366, and Lot No. 2883-A consisting of 9,050 square meters covered by Transfer Certificate of Title No. T-35367, both lots being situated in barangay San Miguel, Bacong, Negros Oriental. Lots 2881-C and 2883-A were consolidated and subdivided into 13 sub-lots by virtue of Consolidation/Subdivision Plan (Pcs-07-004520) duly approved by the Land Management Sector of the Department of Environment & Natural Resources, Region VII, Banilad, Mandaue City on May 10, 2004. Pursuant to the Declaration of Heirship duly annotated as Entry No. 159179 on TCT No T- 35366 and TCT No. T-35367, Lot 6 with an area of 1,000 square meters, was partitioned and adjudicated in favor of Petitioner. In fact, TCT No. T-35366 and TCT No. T-35367 were partially cancelled since all the other sub-lots (except Lot 6 adjudicated to Petitioner) were issued separate titles in favor of the other co-owners pursuant to the Consolidation/Subdivision Plan (Pcs-07-004520) and approved technical descriptions submitted to the Office of the Register of Deeds of the Province of Negros Oriental. For the purpose of issuance of separate title of Lot 6 in her name, Petitioner was in the custody of the owner’s duplicate copies of the subject TCTs. Lately, however, Petitioner discovered that the last page (page7) of the owner’s duplicate copies of the two TCTs were missing, and despite earnest efforts to look for it, she could not find it anymore. Thus, Petitioner had no other option but to declare the owner’s duplicate copies of the subject TCTs as lost in order for the Office of the Register of Deeds of the Province of Negros Oriental to issue new titles thereof. In compliance with Section 109 of P.D. 1529, Petitioner executed an Affidavit of Loss which was duly annotated in the Memorandum of Encumbrance as Entry No. 2017001034 in the original or file copies of TCTs in question with the Office of the Registry of Deeds of the Province of Negros Oriental. Petitioner further averred that the owner’s duplicate copies of TCT No T-35366 and TCT No. T-35367 are not known to be sold, transferred, conveyed or delivered to any person or entity to secure any debt or encumbrance, and that Lot 2881-C and Lot 2883-A they cover are not known to be attached, pursuant to any order of any court or tribunal. We were there in Marawi with my neighbors, both Christian and Maranao families, going through the same ordeal of fear. But we made sure that our Christian neighbors would be concealed from being among us Muslims. We shared with them our traditional clothing so they would look like us. Then I received a text message from a relative that our area would be bombed soon. We were told to move out again, and not to stop running until we reached the bridge where government soldiers were waiting for us with rescue trucks. So we started running as fast as we could. But before we could reach the bridge, the Mautes grabbed my son! My heart started pumping so fast, and my tears were flowing. I could no longer shout for help, and my legs suddenly felt numb. From a distance, I could see them interrogating my son. I was praying so hard, wanting to run back to help explain, but I could no longer move my legs. I was so scared. Those who were running with me had to stop and assist me but I could not move my body. They tried to place me on a bike but I could not even raise my leg. As I continued to struggle, I
felt someone embrace me and carry me into a bike. Then I realized the person who was helping me into the bike was actually my son! I touched his face and cried harder. (The Mautes released him after they saw that he was holding our Muslim rosary beads.)
We continued to run for our lives, as I regained strength knowing that my children were with me in that race to freedom. Then gunshots were directed towards us as we were approaching the bridge but the soldiers were quick enough to shield us until we were all able to climb on the rescue trucks which took us to the evacuation shelters in Iligan.
Sept. 13, 2017, starting at 8:30 in the morning at the sala of this Court located at the 3rd floor, Hall of Justice, Piapi, Dumaguete City. All persons having or claiming interest in the subject matter of the instant petition are hereby directed to appear and show cause why the Petition should not be granted. Petitioner is directed to cause the publication of this Order at her expense in a newspaper of general circulation in the Province of Negros Oriental and its component cities once a week for three consecutive weeks, and to post copies thereof in the premises of Lot No. 2881-C and Lot No. 2883-A, and to show proof of compliance thereof. The sheriff of this Branch is directed to post copies of this Order at the entrance door of this Court, as well as in the respective bulletin boards of the OCC, RTC, Hall of Justice, the Office of the ROD, this Province, the Municipal Hall of Bacong in Negros Oriental, and at the Provincial Capitol, Dumaguete City.
