Te appeal also argues that the trial court erred in its instructions as to causation and created a prejudicial and defective verdict form that was not an accurate statement of law.

In this case, appellant was sued by his former law firm in order to recover legal fees.


In his appeal from summary


judgment in favor of the law firm, appellant alleges that (1) the trial court failed to consider the appellant’s defenses in his opposition, and (2) there was insufficient evidence for the trial court to grant summary judgment.


Tis appeal raises the issue of the scope of the language of the Maryland statute imposing requirements on the use of medical expert witnesses. In particular, the question is whether an expert witness, board certified in oral and maxillofacial surgery, is “board certified in a related specialty” with the defendant, who is board certified in family law, yet practices emergent care, and in the case of the plaintiff, was providing treatment for facial injuries.
