On appeal, in addition to recounting these facts, the plaintiff notes that the Maryland Code language requiring these certificates provides that the appropriate penalty is merely a dismissal with prejudice, which would have allowed refilling after an appropriate certificate was obtained. Instead, the present decision bars the plaintiff from the courthouse despite the medical certification that his claim is worthy.

Tis case was transferred, apparently on forum non conveniens grounds, from Prince George’s County to Montgomery County based, at least in part, on an affidavit from the defendant doctor alleging that “most” of her practice was in Montgomery County. At a subsequent deposition, the doctor testified that her “main office” was in Prince George’s County. Te Circuit Court for Prince George’s County had taken the affidavit at face value, without providing the plaintiff the opportunity to request or conduct discovery on the point. Te primary issues on appeal are whether discovery should have been allowed on this point and whether the transfer was appropriate under all of the circumstances.
