Great news for drivers and their

companies! The new FMCSA policy for handling adjudicated violations will become effective in August, 2014, which will allow for the removal or reduction of CSA SMS points via the DataQs system. Starting with violations occurring

after August 23, requests may be made, through DataQs, that SMS points accruing from violations which are later found dismissed or reduced to a lesser charge be accordingly removed or reduced. To benefit from this new policy, documentation must be submitted verifying the outcome of the adjudicated citation. The attorneys of Drivers Legal Plan,

one of the nation’s most prolific filers of DataQs challenges, welcome this overdue change with much zeal. They file an automatic and FREE DataQ challenge on behalf of every defended member driver, and now the incredibly favorable affect rate the law firm has historically realized should translate directly to the SMS bottom line. “This is probably the biggest

regulatory benefit to drivers and their carriers since the advent of the CDL,” said Jim Klepper, President of Drivers Legal Plan, “the benefit our law firm can deliver to our clients has now been multiplied dramatically.”
