managed deer hunts. In response to MHC’s concerns, Secretary Gill asked the budget committees to include a request that DNR conduct a Deer Population Management Report (Committee Narrative K00A03.01) to assess the relative impact of Sunday hunting versus other deer herd reduction strategies.


DNR also appointed Boonsboro horseman, hunter and farmer Joe Michael to their Wildlife Advisory Committee, which is comprised of citizen stakeholders appointed by the Governor and which works with DNR’s Wildlife and Heritage Services. All hunting matters in Maryland (from deer hunting to foxchasing) come under the regulatory authority of DNR’s Wildlife & Heritage Services. Joe’s participation on that committee will improve the Maryland Horse Council’s


ability to better inform our


members of DNR intentions with respect to hunting days, and will likewise improve our ability to communicate with DNR on hunting-related matters that impact our members who ride on open land (public and private). Joe Michael is the fi rst horseman to serve on the committee since Ed Fry’s term ended several years ago.


Howard County Sued; Alleging Violating Civil Rights


According to the Baltimore Sun, retired police


sergeant and Charles County resident Tomi Finkle is suing Howard County in a federal court alleging employment discrimination, claiming transgender bias in the county by refusing to award Finkle a spot on the Howard County volunteer mounted patrol unit. In court fi lings, the county has argued that Finkle cannot sue for job discrimination because a voluntary position is not employment. T e county also argued that courts disagree on whether federal antidiscrimination law covers transgender people and that Finkle has not shown that police offi cials knew she was transgender. T e Maryland Commission on Human Rights dismissed Finkle’s claim last year, but not on the question of whether she was a victim of discrimination. T e commission’s deputy director wrote in September that the case had been closed “for lack of jurisdiction over this matter because there is no established employee/employer relationship.” However, the Equal Employment Opportunity Commission also heard the case and gave Finkle permission to sue. And so it goes.

Mobility Act (H.R. 1528) out of Committee on April 3, 2014. T e bill is sponsored by Representatives Kurt Schrader of Oregon and Ted Yoho of Florida, both of whom are veterinarians. T e Veterinary Medicine Mobility Act amends the Controlled Substances Act (CSA) to clarify that veterinarians are allowed to transport, administer and dispense controlled substances and medications outside of their registered offi ces and hospitals. It would ensure that equine veterinarians have the ability to provide mobile or ambulatory services in the fi eld to the horse community as they traditionally have. T e Drug Enforcement Administration (DEA) changed its interpretation of provisions of the CSA regarding what veterinarians may carry with them and has stated it now believes it is illegal for veterinarians to transport controlled substances and medications for use outside of their registered locations, such as an animal hospital. But equine veterinarians often provide mobile


services and treat horses at farms, training facilities, horse shows, or racetracks. In many cases it is not possible for owners to bring their horses to a clinic or hospital. For this reason, veterinarians have for years carried with them continued on pg 85
