PERSPECTIVE 1WITH0 QUESTIONS

WHAT ARE THE MOST FREQUENT QUESTIONS YOU ENCOUNTER WITH REGARDS TO REGULATIONS? Clery act questions have become pretty frequent for most schools, as have questions surrounding development of on- line programs (state authorization issues, accreditor issues).

WHAT DO YOU THINK ABOUT THE NEW RULES AND REGULATIONS WE’VE SEEN INSTITUTED IN 2012? It has been a challenging year. While most of the new rules have been at the state level–in part a reaction to the Department of Education regulations–the difficulty has been in implementing the rules enacted in 2010 and 2011 and dealing with the court decisions.

HAVE THE NEW REGULATIONS ONLY IMPACTED SCHOOLS? It has been a difficult year I think for everyone–the US Department of Education is doing a lot and trying to under- stand the new rules at the same time the schools are. Making matters more challenging has been the cloud of uncertainty over the validity of some of the important rules.

HOW DO THESE REGULATIONS APPLY TO TRADI- TIONAL SCHOOLS?

Te implementation challenges have been difficult for all schools, but traditional schools typically don’t have tons of resources to devote to implementation. Worse has been the various state authorization rules have made the process of innovation more difficult for schools with fewer resources to being with.

WHAT ARE HIGHER ED’S BIGGEST CHALLENGES IN 2012? Finding ways to innovate to (a) cut costs for students while (b) raising more revenue.

DENNIS CARIELLO

DLA Piper’s Dennis Cariello on new regulations and the challenges they pose for schools.

We had the chance to sit down with Dennis at the Association of Private Sector Colleges and Universities annual conference and explore the landscape of higher education. Here are some follow up questions we asked Dennis afterward...

WHAT WORDS DO YOU LIVE BY? Stop what you’re doing if it will look bad in tomorrow’s papers.

WHAT’S YOUR BIGGEST VICE? Ice cream. It almost doesn’t matter what type (although but- ter pecan is my favorite, closely followed by soft serve vanilla with chocolate sprinkles).

WHAT SONG IS ON REPEAT RIGHT NOW ON YOUR iPOD? Repeat? None. I cycle through a bunch of songs from the Beatles, Billy Joel, Pink Floyd, Beach Boys, Guns ‘n’ Roses– mostly classic rock.

iPHONE OR DROID? Currently neither–I have a Blackberry because I love email- ing. But I will get the iPhone 5 when it comes out (and will keep the Berry).

IF YOU HAD ONE LAST MESSAGE TO SEND USING THAT IPHONE OR DROID, WHAT WOULD IT BE? I would tell my wife and children that I love them one last time.
