• $5,000 per each negligent violation in one year;


• $25,000 per each intentional viola- tion in one year;


• $250,000 for a violation committed knowingly or intentionally that in- volves using PHI for financial gain; and

Dentists should not independently diag- nose and treat sleep apnea because they are not trained to do so, the Texas Medi- cal Association told officials of the Texas State Board of Dental Examiners. “It is beyond the scope of practice of dentistry in Texas to diagnose a medi- cal disease or disorder, including a sleep disorder, or to independently treat such disorder once diagnosed,” TMA Presi- dent Stephen L. discuss the proposed rules. It discussed modifications and was expected to pro- pose a new set of rules in September. Based on the discussions at the August board meeting, TMA is concerned that the dental board is considering adopt- ing a rule that would allow dentists to screen patients for sleep disorders with a home sleep study, without requiring a physician to interpret the results. TMA also worries the rules may per-
