medical uses can be protected by utility models. A major advantage of a utility model is the grace period. When an inventor has a published invention for no longer than six months, a utility model can still be granted while patent protection in Europe is excluded.


TF: Utility models are useful tools to use in litigation because they allow the plaintiff to start proceedings early. Te typical situation in which to use them is when a patent, or soon-to-be granted patent application, has an independent, broad product claim that allows an invention to be developed into several individual product lines. Each utility model can be tailored to each specific development, and even to specific infringing embodiments. Litigation could then be brought against the infringing embodiments before the patent has even been granted.

Dr Thomas Friede is a German and European patent attorney, holding a PhD in biochemistry. His practice comprises the prosecution and licensing of patents and utility models, including opposition and appeal proceedings before the European Patent Office and invalidity proceedings before the German Federal Patent Court; supplementary protection certificates on pharmaceuticals, patent infringement litigation, opinions on the validity and scope of patents, freedom-to-operate and due-diligence analysis, and employee inventions law. He specialises in life sciences and pharmaceuticals, particularly in gene technology, biochemistry, molecular biology, gene therapy, cell biology, immunology, virology, pharmaceutical and organic chemistry, DNA arrays, medical devices and chemical engineering.


Johannes Heselberger is a German attorney-at-law and European patent attorney, holding a degree in physics. His practice covers patent infringement and validity litigation, including opposition and appeal proceedings before the German Patent and Trademark Office and the European Patent Office as well as national revocation proceedings before the German Federal Patent Court and the German Federal Supreme Court. His technical fields of expertise are medical devices, telecommunications and the automotive industry.
