by way of leading Private Hirtwell on to a connected narrative, but that is .jrrst what he wa.s orrt to avoid, and he kept Mrictly to the queries, volunteered nothing and tried to make it ail appear perfectly slraightfonvard and siiuple. But when it takes “ an ;hour oi' nrore ’’ to gm half-a-mile when one is naturally anxious to “ get there,’’ .something •more than the customary can be said to have happened. For a real appre- ciarion of what happened it i.s better to take the word of the loolcer on, and seeing that Private BirtweU studiously avoid.s giving any idea of what occurTod iro must—at the ri.sk of incurring' ’’Jimmy’s ” wrath—reiterate his Battalion Commander’s report. dm'iug tile Derby Scheme, and was ex amined by Dr. Urme the following day, then being rejected. A later caRmg- up notice was cancelled, and on August loth, this year, applicant received a pink form calling on him to be re examined. Applicant ignored that notice, because ho hud attained the ago of 41, and believed himself exempt from miiitaiy service. Lieut. Trappes- Lomax at first agreed that a]iplicunt did nut come under tho Act, but later he again called him up. An order was originally issued by wilnick attested single men who were 41 after Mareh-2nd ana altested maiTied men 41 alter J uuo 24tb. were excepted. An outcry was raised that unuttesLed men were being belter treated than attested men and the lualtei' was raised in Parliament. Mr Lloyd George then said the pledge of his Majesty’s Government was that unatlested men were not to receive more favourable treatment. In view of that s'tatement appficaut was clear. Under the Act men were eieai' who be came 41 within 6U days from the day the Act was passed,

Mr. Healey stated applicant attested in the case of re-

,|ected men, however, the appointed date for the Act to be applied to them was 1st September, so that if a man was 41 witbiu 36 days of that date he was exempt. Applicant fulliilod that coa- ditiou, being 41 ou the 29th September, and he was therefore clear'.

Mr. Robinson said the original in-

.sti'uctious were that attested single men were to be 41 belore Mardhi 2nd; and attested married men 41 before 24th une, to be clear from military service,

and he held those instructions held good.

Mr. Healey said that was contrary to

the pledge of the Government. Mr. Aitken agreed with Mr. Healey’s

interpretation of the regulations, ex pressing the opinion applicant was out side the scope of the Act, but he Joiihted tho competenc.y of the tribunal to give a decision on a legal point. Either the

Loniax said applicant would have to go up for service unless he obtained ex emption from a local tribunal, and ho was right in asking for their clecLsioii. If the man had been 45, and was called up by mistake, they would at once have granted absolute exemption. Mr. Robinson : It is a matter i f hours

only. Mr. Aitkeu suggested an adjournment

to secure a ruling from the Local Gov ernment Board on the matter. Mr. Healey agreed with that course,
