The wording of the opinion is interesting as it effectively says that the court was not able to set a limit on the number of overflow spills per year; but the limit was 20.

The UWWTRs do allow an exception to protect society from excessive costs. This means that the requirements could be relaxed if the cost of compliance exceeds the value of the benefits that would be achieved.

Following on from the EU court case and


growing public pressure for reduced discharges the government brought in a new policy for England in the Storm Overflow Discharge Reduction Plan of 2022 (SODRP).


This set out three new targets: • No local adverse ecological impact.


• Significantly reduce harmful pathogens from storm overflows
