HARBOUR BYELAWS


This section highlights some of our Byelaws and gives a brief overview of them. All Dart Harbour Byelaws must be adhered to, the full list and exact wording can be found on our website www.dartharbour.org or alternatively a hard copy can be picked up from the Harbour Office. Dart Harbour will soon be replacing the Byelaws with General Directions, which have a similar force of law.


Speed & Wash of Vessels.


The harbour limits begin at the Starboard (green) Castle Ledge buoy out in the mouth of the Dart and cover all the way up to the weir at Totnes. The speed limit is 6 knots through the water, until Home Reach in (near Totnes), where it becomes dead slow, which is a speed no greater than necessary to maintain steerage way. No vessel shall cause excessive wash, or wash that is likely to damage other vessels, riverbanks or other environmentally sensitive areas.


Drink & Drugs No person shall navigate any vessel in the harbour whilst under the influence of drink or drugs to such an extent as to be incapable of taking proper control of the vessel.


Vessels to navigate with care The Master of a Vessel shall navigate their Vessel with such care and caution, and at such speed and in such manner as not to endanger the lives of or cause injury or discomfort to persons, environmental damage, or damage any property, and as not to interfere with the navigation, manoeuvring, loading or discharging of Vessels or with moorings, river banks or other property, and shall cause their Vessel to proceed slowly when passing a Vessel engaged in dredging or other underwater work or activity or in work at a buoy or mooring or in rescue work


Persons under 16 No person under the age of 16 years shall navigate or operate anywhere within the Harbour a power-driven Vessel which is capable of attaining a speed through the water in excess of 6 knots, unless accompanied by a competent and responsible person of 16 years or over.


Diving


No person shall underwater dive (commercially or recreationally), within the Harbour without a Permit issued by the Harbour Master.


Passenger Vessels (& the carrying of paying passengers) Passengers must only be carried on vessels which are licenced to do so, and such vessels must be under the control of a person licenced to carry passengers.

All vessels are to exhibit navigation lights that are appropriate for their length and type of vessel. This includes tenders and dinghies, that as a minimum must carry an all-round white light when underway at night.


Fire precautions Every vessel in the harbour shall take all reasonable precautions for the prevention of accidents by fire. No person shall light a fire, BBQ or similar on any part of the harbour premises, this includes on pontoons, without permission from the Harbour Master.


Recommendations. The recommendations below are expected to become rules with the introduction of the General Directions. Paddle and Rowing craſt. Paddle boarders, kayakers, canoeist, rowers, and other river users who are more vulnerable to damage or injury from collision or wash should avoid using the fairway downriver from Duncannon. Where these users need to cross the fairway, they should choose the shortest route practical. Any vessel outside the fairway shall keep a particular look out for the above types of harbour user, and shall navigate with caution, keeping well clear. Swimming. Swimming is not prohibited in the harbour; however, no person shall swim in an area of moorings or in or across the Fairway. If you are swimming in the harbour, you must use a tow float or brightly coloured swim hat. Use of Lifejackets. When there is a risk of falling overboard, any young person under the age of 12 years old, shall wear a suitable lifejacket or buoyancy aid. We recommend that any person on board a Vessel, shall wear a suitable lifejacket or buoyancy aid, especially where there is increased risk, such as at night, on a small dinghy or during heavy weather. We recommend that all crew should wear a lifejacket when there is a risk of falling overboard.
